1. Scope
These Terms of Service apply to the use of the mobile app my-receipt (known as „meinBeleg" in Germany), provided by ActNow GmbH, Torstrasse 33, 10119 Berlin, Germany (hereinafter “Provider”).
2. Subject Matter
The Provider offers a mobile application with the following features:
- Scanning and OCR recognition of receipts via camera or photo import
- AI-powered extraction of receipt information (amount, date, category, merchant)
- Management and categorization of receipts and expenses
- Cloud synchronization of data (servers in Germany)
- Export of reports (e.g., as CSV or PDF)
3. Contract Formation and Use
The contract is formed upon downloading and first using the app. A valid Apple ID account, acceptance of these Terms of Service, and the Privacy Policy are required.
The app is intended for users who are at least 18 years of age.
4. Subscriptions and In-App Purchases
Certain features of the app require payment and are offered as subscriptions through the Apple App Store.
- Billing: Billing is handled by Apple according to the prices in the App Store at the time of purchase.
- Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the billing period.
- Cancellation: Cancellations are made via iOS Settings under “Apple ID → Subscriptions”.
- Refunds: Refund claims are governed exclusively by Apple’s policies.
ActNow GmbH does not receive any payment data (credit card numbers, etc.) from Apple.
5. Usage Rights
The Provider grants the user a non-exclusive, non-transferable, revocable right to use the app for personal and professional purposes. The app and its contents may not be copied, modified, distributed, sold, or lent.
6. User Obligations
The user agrees to:
- Use the app only for lawful purposes
- Not process third-party content for which they are not authorized
- Keep account credentials secure
7. Availability
The Provider strives for high availability of the app and server services. There is no entitlement to uninterrupted availability. Maintenance work may lead to temporary restrictions.
8. Limitation of Liability
The Provider is liable without limitation for damages resulting from injury to life, body, or health, and for intentional or grossly negligent breaches of duty. For slightly negligent violations of essential contractual obligations (cardinal obligations), liability is limited to the typical, foreseeable damage.
Further liability is excluded. In particular, the Provider is not liable for data loss caused by the user or for the accuracy of AI-powered receipt extraction.
9. Term and Termination
This contractual relationship exists for an indefinite period. The user may delete the app at any time. The Provider may discontinue the service with reasonable notice.
In cases of serious violations of these Terms of Service, the Provider may block the user’s access with immediate effect.
10. Changes to Terms of Service
The Provider reserves the right to amend these Terms of Service with reasonable notice. For significant changes, the user will be notified in the app. Continued use of the app after the change constitutes acceptance.
11. Applicable Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants and legal entities under public law is Berlin.
